TERMS & CONDITIONS KEMI TOURISM LTD 2016-2017 - INDIVIDUALS

The following terms and conditions shall be applied for services offered and delivered for individual customers during all seasons by Kemi Tourism Ltd, in Kemi and any other area of where the services are delivered.

Service and prices:

Kemi Tourism Ltd reserves the right to change the prices in case of unforeseen increases in costs (including but not limited to taxes, fuel prices etc.) beyond the control of Kemi Tourism Ltd. The given prices include VAT according to the Taxation Laws and Regulations of Finland. Kemi Tourism Ltd uses subcontractors in transfer and safari services.

Liability and liability insurance:

Kemi Tourism Ltd shall exercise pro-activity, contingency, due diligence and appropriate health and safety measures in accordance with the laws and regulations of Finland and the Finnish standards of recommended practices of programme services at all times when delivering offered services under these terms and conditions. Kemi Tourism Ltd has a General Third Party Liability Insurance for bodily injury and property damage according to the terms and conditions of If P&C Insurance Company Ltd.

Safaris:

All snowmobiles used in the safaris are insured as required by the Finnish law and the coverage is subject to the above mentioned Motor Liability Insurance terms and conditions. Under the provisions, any person suffering bodily injuries is entitled to receive compensation for the cost of medical treatment, pain and suffering, and handicap, in accordance with the terms and conditions of Motor Liability Insurance and laws and regulations of Finland. Compensations are based on tariffs in accordance with laws and regulations of Finland and orders of the Finnish authorities. If an injured party has willfully or out of gross negligence caused his/her own injury, the injured party is not entitled to compensation.

As the responsible safari organizer, Kemi Tourism Ltd. or it´s subcontractors reserves the right to change the routing, schedules and duration of the excursions if necessary, due to prevailing weather conditions, or if deemed advisable due to safety reasons and the comfort of the participants. Kemi Tourism Ltd. also reserves the right to discontinue the safari if a participant is seen as a potential danger to him/herself or to others, or is in poor health.

Other injuries:

Kemi Tourism Ltd may only be held liable for personal injuries or material damage arising from accidents that have happened during the delivery of the offered services and which are caused by negligence of Kemi Tourism Ltd or its employees or sub-contractors or by the provision of faulty equipment. Kemi Tourism Ltd is not liable for any accidental damage or injury which has to be indemnified under the travel insurance of a customer. Personal travel insurance is always highly recommended.

Program services can be physically demanding and the participants may be exposed to vibrations. If the Consumer is having any type of health problems, including but not limited to, heart disease, back problems or similar, or if Consumer is pregnant, she/he should contact prior the participation the medical experts to make sure whether the medical experts consider him/her to be able or not to participate. It´s the responsibility of the Consumer to consult Kemi Tourism Ltd. whether he/she is capable to participate on health or any other point of view.

Confirmation and payment:

Reservation is considered confirmed when the payment is received by Kemi Tourism Ltd. 100% from the total amount is due immediately. In case the payment is not received by the due date, we withhold the right to cancel the reservation.

Invoicing:

For reservations under 50 € and invoices sent via mail, a 10 € invoicing fee will be charged.
A bank payment fee of 5 € is charged, if the customer wishes to pay via bank account.

Cancellation of the reservation:

More than 28 days prior to arrival - 10% from the total amount / person to be charged.
27-14 days prior to arrival - 50% from the total amount / person to be charged.
13 - 0 days prior to arrival - 100% from the total amount /person to be charged.

Changes:

All cancellations / changes / re-confirmations must be made in writing and dated (fax or e-mail), within the office hours in Finland (8-16, +2 GMT). Changes later than 28 days prior to customers arrival: Kemi Tourism Ltd. withholds the right to charge 30 € extra cost for changes.

If the reservation is made via sales office, Kemi Tourism Ltd. charges non-refundable reservation fee (30 € / reservation). The reservation fee is not charged if the booking is made in web shop.

Child rates:

Child 0-3 years: free of charge
Child 4-11 years: -40 %

Passenger / rooming information

To be sent to our office 28 days prior to the arrival. Necessary information: full name, gender, day of birth (dd.mm.yyyy) and nationality.

Kemi Tourism Ltd withholds the right:

  • to change the timetables / contents of the Icebreaker Cruises due to ice or weather conditions or similar reasons
  • to cancel a Cruise in case of lack of appropriate amount of passenger reservations. Such cancellation must be communicated to the client min 28 days prior to the scheduled departure.

Force Majeure:

The SnowCastle and Icebreaker Cruise services are subject to weather permitting. Neither Party small be held liable for any default, damage or loss due to a Force majeure condition or any other unreasonable impairment of the Party operations due to a similar cause (including but not limited to war, strike, weather, lack of snow and ice, or other natural conditions).

Applicable Law and Jurisdiction:

These terms and conditions shall be governed by and construed in accordance with the Finnish Law.
The Finnish Courts shall have the exclusive jurisdiction to settle any dispute, controversy or claim related to such a demand. The District Court of Kemi-Tornio (in Finnish: Kemi-Tornion käräjäoikeus), placed in Kemi, shall be the court of first instance. Severability if any part, term or provision of these terms and conditions are partly or wholly held invalid, illegal or unenforceable, the validity or enforceability of other provisions, extent part and remainder of these terms and conditions shall remain in full force and effect.

 

Kemi Tourism Ltd. terms and conditions for Seaside Glass Villas for consumers 1.12.2016-30.4.2017

In order to guarantee the best possible arrangements for the successful holiday, we require the following conditions and recommendation, if not agreed otherwise. The following terms and conditions shall be applied for services offered and delivered for all customers during the time mentioned above in Seaside Glass Villas by Kemi Tourism Ltd, in Kemi.

Kemi Tourism Ltd. is under no obligation to accept cancellations without charges for example, on the basis of a medical certificate or any other equivalent. Even in these situations, we apply the cancellation terms mentioned in our terms and conditions .

Reservation and confirmation

These terms and conditions become binding to both parties once the customer has made the reservation. The customer must be over 18 years old. After making a reservation, you will receive a booking confirmation and terms and conditions. 

 If the booking is made through the sales office, we will charge € 30 service charge. There is no service fee for bookings made through our web shop.

Reservation via web shop 

Within internet booking, the customer pays immediately the payment in full. Internet booking is paid either by credit card or through a bank service. The customer is responsible for ensuring that he will print a receipt, the description of the services and accommodation and the driving instructions, as well as the booking conditions. The reservation system will send (by reservation ) the booking confirmation to the email address provided by the customer. 

Payment

Within the booking the customer pays immediately the payment in full. Reservation is considered confirmed when the payment is received by Kemi Tourism Ltd. 100% from the total amount is due within the booking. In case the payment is not received, we withhold the right to cancel the reservation.

Changes

If the customer changes the dates of the holiday or else the reservation, it is considered a cancellation and a new booking. 

In case of cancellation

- 119 - 28 days before arrival, 50% from the total amount will be charged

- 27 - 0 days before arrival, the total amount will be charged

 

Kemi Tourism Ltd withholds the right to cancel the reservation

In the case of a force majeure or any other unreasonable impairment (e.g. fire or water damage) Kemi Tourism Ltd withholds the right to cancel the reservation. In this case, the customer is entitled to reimbursement of the sum in full. If the payments on the reservation is not paid on time, Kemi Tourism has the right to cancel the reservation .

Check in/check out

Check in time is at 16.00 and check out at 11.00.

Cleaning

Cleaning after the check out is included in the room rate. Although the final cleaning is included in the price, the normal housing is required meaning that furniture and other equipment are in the right place and in a good condition. Additional cleaning fee will be charged if the space is stained (e.g. vomit) or a bed soaked. We will charge cleaning costs, however minimum 300 € . The customer is obligated to pay to Kemi Tourism Ltd. for any damages caused.

Damages and abnormal or dangerous situations

Please do not touch the glass, pour water or throw any objects to the glass roof or windows. Don't place any heavy object next to the windows. 

Accommodation may not be used by more people than what has been reported as capacity. Use of a tent, camper and caravan in the Villa area is not allowed.

Smoking is strictly prohibited. If  smoked in the Villas, we will charge cleaning costs, however minimum 300 €. No animals / pets allowed.

If the customer does not in spite of the notifications by Kemi Tourism Ltd stop causing disturbance or danger in the same or neighboring premises, Kemi Tourism has the right to terminate the contract immediately and the costs of all the measures above will be invoiced to the customer.

The customer is obligated to report Kemi Tourism Ltd. immediately about any damages in the Villas caused by the customer and pay the cost of the damage intentionally or unintentionally caused to the property.  The customer will be responsible and charged for any unnecessary alarms caused by the customer e.g. fire alarms and the costs from them are charged  from the customer

Complaints

All comments related to the equipment and condition of the accommodation must be presented immediately and during the holiday directly to Kemi Tourism Ltd. If the customer has not been in contact with  Kemi Tourism Ltd. during the stay about any discomfort, he loses the right to any refund. If the solution on the matter is not satisfactory to the customer during his stay with Kemi Tourism Ltd., notice must be sent in writing to Kemi Tourism Ltd. no later than one week after the end of the holiday in Kemi. If the customer and the Kemi Tourism Ltd. can not reach an agreement on the case, the customer may refer the matter to the Consumer Complaint Board 

Other conditions

Accommodation reservations are not covered by the Package Travel Act. Kemi Tourism Ltd is not responsible for printing errors nor any changes made after the printing of the brochures. Kemi Tourism Ltd. reserves the right to change the prices and to correct the errors in price information before signing a contract.

There is a free internet connection in the Villa area. We provide iPads for Villa guests from the reception. Credit card guarantee is needed and there is a limited availability.  iPad needs to be returned in good condition to the reception upon check-out. In case of any disturbance in the internet connection Kemi Tourism Ltd. is not liable for compensation to the customer.
